PREAMBLE

OLIVALITE, S.L.U., with CIF: B-01747633 and address at Calle Infanta Mercedes nº 96, 28020 Madrid; Registered in the Mercantile Registry of Madrid, Volume 40.286, folio 1, Page M-724255; with e-mail address pedidosweb@olivailuminacion.com and telephone 91 358 19 93; performs the sale and distribution of the products offered in this service.

The purchase system is subject to the legislation in force in Spain.

The products offered in this service are aimed at end consumers under the terms and conditions provided by the Retail Trade Act.

The shipment of orders will be made both in national territory (Peninsula, Balearic Islands, Canary Islands, Ceuta and Melilla), as well as to countries of the European Union and foreign countries, except Afghanistan, Yemen and North Korea.

In accordance with the provisions of current regulations on Personal Data Protection, OLIVALITE, S.L.U. informs users that the personal data collected during the registration process and subsequent purchase, will be to manage your purchase and the fulfillment of legal obligations, including, without limitation, the law 10/2010 on prevention of money laundering. ARTICLE 1 – OBJECT

The purpose of these general conditions is to define the terms and conditions of sale between OLIVALITE, S.L.U, and the customer, from the order to the services, including payment and delivery.

ARTICLE 2 – ORDER

The customer will order directly from the product sheets presented on the Website. To place an order, the customer must provide his/her user name and password, in case he/she is already a customer, or by filling in all the blanks of the online order form without spaces and dots. From the moment the order is placed, the customer fully and entirely accepts the prices, the description of the products on sale and the general conditions of sale.

ARTICLE 3 – DELIVERY

The products will be delivered to the address indicated by the customer when placing the order.

In case of absence, the company will send a notice via telephone and/or e-mail with a telephone number to arrange delivery with the private carrier.

The general delivery time is:

  • For deliveries in the Peninsula, between 15 and 30 working days.
  • For deliveries in Balearic Islands, between 15 and 30 working days.
  • For deliveries to the Canary Islands, between 15 and 30 working days.
  • For deliveries to Ceuta and Melilla, between 15 and 30 working days.
  • For deliveries to European Union countries, between 15 and 30 working days.
  • For deliveries to other European countries, between 15 and 30 working days.
  • For deliveries to South American countries, between 15 and 30 working days.
  • For deliveries to North American countries, between 15 and 30 working days.
  • For deliveries to countries in Asia, Africa and Oceania, between 15 and 30 working days.

Delivery times may vary depending on the type of product.

The company will not be responsible for delays caused by reasons beyond its control or force majeure.

ARTICLE 4 – FREIGHT

For shipments to Spain (Peninsula, Balearic Islands, Canary Islands, Ceuta and Melilla) and European Union countries, shipping costs will be borne by OLIVALITE, SLU.

For countries outside the European Union and other foreign countries, shipping costs should be consulted by the customer prior to purchase by sending an email to the following email address: pedidosweb@olivailuminacion.com . Please note: i) that shipping costs to these countries may vary depending on the product or products ordered, their weight and volume, as well as the place of delivery; ii) that some products, due to their characteristics, voltage, types of network, etc., may not be valid in certain countries; iii) that the customer acts as the importer of the product and customs policies vary from country to country. may not be valid in certain countries; iii) that the customer acts as importer of the product and customs policies vary from one country to another, so we advise you that prior to making the purchase you should contact the relevant customs office to be informed about import restrictions that may apply to the products you wish to purchase through this Website; iv) that OLIVALITE, S.L.U. will not be responsible for product returns that may occur as a result of the above issues.

ARTICLE 5 – PRICES

The sales prices indicated on the Website are shown in Euros, including VAT and taxes. [1]. The prices to be applied are those in effect at the time of ordering.

 

All products marketed by OLIVALITE, S.L.U, generate Eco-RAEE

Eco-RAEE rate applicable according to type of product:

LED and non-LED luminaires (professional and domestic) and Signs (professional).

  • Up to 1 Kg 0,08 € 0,08
  • From 1 to 2 Kg 0.50 € 0.50
  • More than 2 Kg 0.90 € 0.90

Straight fluorescent lamps, discharge, sodium and LED tubes and E40 LED 0.30 € 0.30

Compact fluorescent 0.20 € 0.20

LED retrofit (GU10, E14, E27, etc…) 0.11 €.

These fees allow suppliers to comply with RD RAEE 110/2015 and are mandatory.

ARTICLE 6 – FORM OF PAYMENT

The orders will be paid by VISA/MASTERCARD/AMERICAN EXPRESS card payment (THROUGH STRIPE). You can consult the conditions here*.

OLIVALITE, S.L.U, may increase or reduce the number of payment methods at any time.
The customer will select the payment method chosen from those available at the time of purchase.

The total amount of the order will include: the price of the product or products ordered, as well as the costs of packaging, shipping, fees and taxes.

ARTICLE 7 – SIGNATURE AND PROOF

The customer who does not have a user name and password will have to follow a registration procedure that will allow him to obtain them. The online indication of the credit card number and the final validation of the order will constitute proof of the order in accordance with the legal provisions and will allow the enforceability of the sums that will appear on the order form. This validation is valid as signature and acceptance of all operations carried out on the Website.

ARTICLE 8 – WARRANTY

In accordance with the provisions of Royal Legislative Decree 1/2007 of 16 November, all products sold by OLIVALITE, S.L.U. benefit from a legal guarantee that lasts for two years from the date of delivery.

The customer must inform the seller of the lack of conformity within two months of becoming aware of it.

Deficiencies caused by negligence, blows, improper use or manipulation, unsuitable voltage, incorrect installation not carried out by the authorized Technical Service when applicable, or materials subject to wear and tear due to normal use are not included.

In those incidents that justify the use of the warranty, the repair, replacement of the article, discount or refund will be chosen, according to the legally established terms.

ARTICLE 9 – REFUNDS

Except for the cases provided for in paragraphs a), c), e), f) and h) of Article 103 of the Law on Consumers and Users, if after placing the order on-line the customer decides to withdraw from the purchase and terminate the contract, he/she may do so freely within 14 working days from receipt of the product, by simply filling out the withdrawal form and sending it to the following e-mail address pedidosweb@olivailuminacion.com . The following link is made available to the consumer, which allows access to the modelo de desistimiento*.

The products must be delivered or sent by the buyer to the following address: Calle INFANTA MERCEDES, 96 28020 MADRID Madrid.

The transport costs originated by the return shall be borne by the buyer.

Both the content and the images that appear on the Web Page, that is, all text, graphic designs, trademarks, designs, logos, icons, photographs or images, audio reproductions and/or data compilations, etc. are owned by OLIVALITE, S.L.U. or its various suppliers of products, services or content, being protected in accordance with the various national and international laws on Industrial and Intellectual Property Rights.

ARTICLE 13 – APPLICABLE LAW AND JURISDICTION

These conditions shall be governed in accordance with Spanish law.

Jurisdiction for the resolution of any dispute that may arise in the interpretation or execution of this contract shall correspond to the Courts and Tribunals of the buyer’s domicile.

Royal Decree 208/2005 of February 25, 2005 on electrical and electronic equipment and the management of its waste (better known as WEEE), aims to control the generation of waste of this type of equipment and to guarantee its correct environmental management once its useful life is over.
